Terms of sale

1. Purpose and scope
These general terms of sale govern the sale of stars by LPH (hereinafter "we"), a société par actions simplifiée (a French simplified joint-stock company) registered with the Troyes Trade and Companies Register (RCS) under number 882 417 843, to users of the website www.1-signature.fr (hereinafter "you").
They apply to consumers and professionals alike. Provisions reserved for consumers are identified as such; they apply only to natural persons acting for purposes outside their commercial, industrial, craft, liberal-profession or agricultural activity.
Any order entails unreserved acceptance of these terms, in the version in force on the day of the order.
2. The service
1-signature allows a natural person to electronically sign a PDF document, for themselves, in a single transaction and without creating an account.
What the service is not, and which matters to say before purchase:
- it is not a tool for having third parties sign: you are the signatory;
- it is neither a digital safe nor a long-term archiving service;
- there is no user account, and therefore no history that can be consulted online.
The signature itself is carried out by Goodflag Signature, a trust service provider. LPH acts as a reseller and issues no certificate.
3. Stars and SignPass
3.1 The star
The star is the service's unit of account. A signature consumes a number of stars that depends on the level chosen:

The applicable cost is the one displayed at the moment you choose your level. Any later change to the price list has no effect on a transaction already under way.
3.2 The SignPass
The stars purchased are held on a SignPass, identified by a code.
The SignPass is a bearer instrument: anyone holding the code can spend the stars it contains. It is up to you to keep it as carefully as you would keep any instrument of value.
- Validity: 12 months from the last purchase. Any top-up extends the expiry date of all the stars on the SignPass.
- Cap: 100 stars of balance. A top-up that would exceed this cap gives rise to the issue of a separate SignPass; no paid star is lost.
- Stars are neither refundable nor convertible into cash, unless the service cannot be provided through our own fault.
3.3 The code cannot be sent to you again
We keep no copy of the code of your SignPass, neither in plain text nor in any form we could decrypt: only a cryptographic fingerprint is stored, which makes it possible to recognise a code presented to us but not to reconstruct it.
The code is given to you twice — displayed after payment, and sent by email with your invoice. After that, it can no longer be retrieved.
In the event of loss, and upon proof of purchase, we may carry out a reissue: a new code is then created and the old one becomes unusable. A reissue is neither a resending nor a return of the lost code.
4. Prices
Prices are stated in euros including all taxes, with French VAT at the rate of 20% applicable on the day of the order.
A star costs €2.50 incl. VAT each. Top-ups benefit from a single discount: one free star for every ten stars paid for.

5. Ordering and payment
Purchasing requires an email address previously validated by a one-time code. In practice, purchases are therefore made from within a signing journey in progress.
Payment is made by bank card, through the Stripe solution. No card data passes through or is stored on our servers. Strong cardholder authentication is ensured in accordance with the applicable regulations.
The order is firm and final as soon as payment is accepted. An invoice is sent to you by email.
6. Immediate performance and right of withdrawal
(Provision applicable to consumers.)
Article L221-18 of the French Consumer Code (Code de la consommation) grants a fourteen-day right of withdrawal for distance contracts.
In accordance with Article L221-28, 1° of the same code, this right cannot be exercised for a service fully performed before the end of that period, where performance has begun with your prior express consent and you have acknowledged that you lose your right of withdrawal.
By ticking the box provided on the purchase page, you expressly request immediate performance of the service and acknowledge that you waive your right of withdrawal as soon as your SignPass is made available to you.
7. Consumption of stars
This article describes a mechanism we consider protective, and from which we do not intend to depart.
- When you choose the level, the stars required are reserved on your SignPass. They are not debited.
- They are debited only once the signature is completed, once the signed document and its evidence file have been produced.
- Any exit from the journey releases them: abandonment, authentication failure, expiry of the signing link, change of level. They then become available again on your SignPass.
In other words, a signature that is not completed costs you nothing.
8. Making the files available
At the end of the signature, two files are made available to you, via a download link displayed on screen and sent by email:
- the signed document, in PAdES-B-LT format;
- the evidence file, in ZIP format, containing the evidence certificate, the evidence record timestamped and sealed by Goodflag, the elements of the consent page and a notice explaining how to verify them.
These files remain available for seven calendar days, after which they are permanently deleted from our systems. It is up to you to download and keep them.
This limited period is workable because the signed document can be verified on its own: the PAdES-B-LT format embeds the certificate chain and the necessary validation information. Its evidential value therefore depends neither on us nor on the availability of a third party.
9. Your obligations
You warrant that:
- you have the right to sign the document you upload, and that this document does not contravene any legal provision or the rights of third parties;
- the identity you declare is accurate. This warranty is essential at level 4, where the certificate is issued in the name you declare without verification by a third party: an error there produces a technically valid signature bearing a wrong name, with no recourse, the stars having been consumed. A summary and an explicit confirmation are put to you before any launch at this level.
At levels 3, 5 and 6, the identity provider verifies your identity and stops the journey in the event of a mismatch, without consuming your stars.
10. Technical prerequisites
Levels 2, 4, 5 and 6 require a mobile phone: France Identité is an app that requires contactless reading of a French credit-card-format national identity card, certified at a town hall; Identité Numérique La Poste is an app that requires prior registration of a French identity card or passport, or of a residence permit valid for at least five years. The prerequisites for each level are shown to you before the stars are reserved.
The document must be an unencrypted PDF, with a maximum size of 10 MB.
11. Liability
We are bound by an obligation of means (best-efforts obligation) as regards the availability of the service and its proper operation.
We cannot be held liable:
- for the content of the document you sign, nor for the legal consequences of your signature;
- in the event that the identity you declared is inaccurate;
- in the event of unavailability attributable to the signature provider, to the identity provider you chose, or to the delivery of messages by the operators;
- in the event of loss of your SignPass code, subject to the reissue provided for in Article 3.3;
- in the event of loss of the files after the availability period set out in Article 8.
With regard to professionals, our liability is in any event limited to the amount actually paid for the transaction concerned, and we are not liable for any indirect damage — operating loss, loss of opportunity, commercial loss.
With regard to consumers, the statutory guarantees of conformity and against hidden defects apply as of right, and no provision of these terms may derogate from them.
12. Force majeure
Neither party is liable for a failure caused by an event of force majeure within the meaning of Article 1218 of the French Civil Code (Code civil).
13. Personal data
The processing of your data is described in our Privacy Policy, which forms an integral part of these terms. In it we set out in particular what we keep, for how long, and why.
14. Complaints, mediation and disputes
Any complaint must be sent to support@1-signature.fr.
For consumers, and after a written complaint that has not received a satisfactory reply, you may refer the matter free of charge to the consumer mediator designated by LPH:

The European online dispute resolution platform is available at <https://ec.europa.eu/consumers/odr>.
These terms are governed by French law. Failing an amicable resolution, the dispute falls within the jurisdiction of the competent French courts; with regard to professionals, jurisdiction is conferred on the commercial court (tribunal de commerce) for the area of LPH's registered office, including in the event of multiple defendants or third-party claims under a warranty.
15. Amendment of the terms
We may amend these terms at any time. The version applicable to an order is the one in force on the day of that order; amendments have no effect on transactions already under way or on stars already acquired.
16. Partial invalidity
If any provision of these terms were held to be void or unenforceable, the others would remain in force.
